HOW TO FILE AN APPLICATION?

Reception and consideration of applications for the grant of plant patents, preliminary examination and taking of grant or rejection decisions, state registration of plant varieties, granting of titles of protection, publishing of official data are carried out by the National Center of Intellectual Property (hereinafter the Center).

An application for the grant of a plant patent is filed with the Center in conformity with the List of Plant Species, which varieties are protected in the territory of the Republic of Belarus according to the Law on Plant Patents:

An application should contain:

  • a petition ;
  • a plant variety questionnaire;
  • a power of attorney if an application is filed through a patent attorney or an authorized agent residing in the Republic of Belarus;
  • a document attesting payment of the fee for application filing (a copy of a payment order with a bank note or a bank receipt) or a document attesting partial payment of the fee and the right to fee exemptions;
  • a certified copy of the “first application“ (that is an application which was filed with one of the state-parties of the International Convention for the Protection of New Varieties of Plants (UPOV) and in accordance with which priority is claimed).

A plant variety obtains a denomination with indication of its generic belonging. It must be short, allow to identify the given variety, differ from the denominations of already existing varieties of the same or close to it botanical species as well as not mislead or cause confusion concerning the characteristics, origin and value of the variety, or concerning the identity of the creator or the plant patent holder.

Plant varieties have the following criteria of patentability: novelty, distinctness, uniformity and stability. The right to a plant variety is attested by a plant patent, which is valid for 25 years from the date of the plant variety registration in the State Register of Protected Plant Varieties. There is simultaneously registered the denomination of a protected variety. The creator receives a breeder’s certificate.    
The application materials should be prepared in accordance with the following normative-legal acts:
