On November 21, 2007, the Government of the Republic of Belarus approved the State Program of IP Protection for 2008-2010.

The State Program of IP Protection for 2008-2010 («the IP Protection Program») was adopted to reinforce the national system of IP by better use of IP rights to meet national policy objectives, to advance the cultural and economic growth and to enhance industry’s competitiveness. This includes the improvement of conditions for promoting creativity and innovation, upgrading innovation support infrastructures and related IP services, enhancing opportunities for foreign investment, and for facilitating IP asset management, valuation and commercialization of the results of research carried out by research institutions, universities and enterprises. The IP Protection Program will help explore and promote new IP concepts, strategies and issues in a knowledge-intensive environment, establish appropriate incentives for artists, writers and inventors, and foster a broader public understanding of IP impact on economic, social and cultural development. It will work on the long-term training for professionals working in the fields of innovation promotion and IP management, and on the analysis and dissemination of information and methodological papers for IP policy development. This Program will also assist with the strengthening of IPR enforcement capabilities.

Belarusian Authors’ Society affiliated to National Center of Intellectual Property.

To improve organization of the collective management of the economic rights of the authors and other copyright and related rights owners (hereinafter referred to as «collective management») the Belarusian Authors’ Society, a republican unitary enterprise, was affiliated to the National Center of Intellectual Property (hereinafter referred to as the NCIP) pursuant to order No 342 of 28.12.2006, issued by the State Committee on Science and Technologies of the Republic of Belarus. The re-organization procedure was over on May 10, 2007.

As prescribed by the Statute on the National Center of Intellectual Property, approved by Resolution No 641 of 31.05.2004, issued by the Council of Ministers of the Republic of Belarus, and the NCIP Charter (registered on 10.05.2007, reg. No 190310695), the NCIP is subordinate to the State Committee on Science and Technologies of the Republic of Belarus and provides for exercising the collective management in the Republic of Belarus, in particular, it is responsible for collecting fees for exploitation of the subject matters of copyright under the agreements concluded with the users.

The NCIP acts as a full cessionary of the Belarusian Authors’ Society in the relations with authors and other owners of copyright and related rights, the collective management societies (or entities) of other states, users. Hence, the entities carrying out exploitation of the subject matters of copyright and related rights under the earlier concluded agreements, shall effect payments of author’s remuneration to the NCIP bank accounts, with relevant agreements being valid and not required to be renewed.
